Gift Card Terms and Conditions

The Gift Card Terms and Conditions set out all conditions applicable to the use of our Gift Cards. You will need to familiarise yourself with the Terms and Conditions before using your Gift Card.

1. Definitions:
1.1. "Card Number" means the 12-digit barcode number that appears on the back of your Gift Card;

1.2. "Gift Card" means the Gift Card that you have purchased from us for use in our store only;

1.3. "Remaining Gift Card Value" means, at any time, that portion of the initial value loaded onto your Gift Card which is unspent and can be accessed by using the Gift Card in accordance with these Terms and Conditions;

1.4. "we", "us" or "our" means Giant Newcastle, Maitland and Belmont (ABN: 47003305548);

1.5. "you" or "your" means a reference to the person who is in possession of the Gift Card at the relevant time for the purposes of these Terms and Conditions, or who authorises another person to take requested action with the Gift Card on their behalf.

2. Accepting the Gift Card and agreeing to these Terms and Conditions:
By purchasing, redeeming or attempting to redeem a Gift Card, you accept and agree to be bound by these Terms and Conditions.

3. Transactions made using the Gift Card:
3.1. A Gift Card entitles the card holder to goods or services in-store at Giant Newcastle, Maitland and Belmont only, equal to the value stated on the Gift Card or remaining after partial redemption.

3.2. The value shown on the Gift Card includes GST.

3.3. Gift Cards are only redeemable in-store at Giant Newcastle, Maitland and Belmont. subject to these Terms and Conditions, and are not redeemable at any other Giant branded retailer, Giant brand stockist or reseller, or online.

3.4. Gift Cards are partially redeemable. Any unused or remaining balance (“Remaining Gift Card Value”) will remain on the Gift Card and cannot be redeemed for cash.

3.5. You agree that we will reduce the Remaining Gift Card Value by the value of all purchases of goods and services that are processed against the Gift Card. The transaction will be completed when the balance has reduced on the Gift Card.

3.6. No change will be given. Any remaining balance on the Gift Card can only be used in whole or part against future purchases subject to these Terms and Conditions.

3.7. Your Gift Card may only be used to make purchases up to the Remaining Gift Card Value. If you wish to make a purchase for an amount that exceeds the Remaining Gift Card Value, you must pay the excess using another payment method.

3.8. You cannot obtain any cash advance with your Gift Card or redeem your Gift Card for cash.

3.9. You acknowledge that the Gift Card may not be used:

3.9.1. to pay a store or credit account; or

3.9.2. for purchases by email, phone or fax.

3.10. We will not replace Gift Cards unless the Gift Cards are proven to be faulty or damaged as a result of the production process or otherwise due to our fault or the fault of our employees, agents or contractors.

3.11. Once the Remaining Gift Card Value is completely used, please destroy your card by cutting it in half diagonally. Your Gift Card cannot be reused or reloaded.

4. Expiry of Gift Cards:
Gift Cards do not expire. Gift Cards can be redeemed at any time even if a Gift Card specifies an expiry date.

5. Lost, damaged or stolen Gift Cards:
5.1. Please treat your Gift Card like cash. We are not liable for any lost or stolen Gift Cards. Lost or stolen cards will not be replaced or refunded.

5.2. Defaced, mutilated or altered gift cards will not be replaced, refunded or redeemed.

5.3. You cannot exchange your Gift Card for a different denomination or type of Gift Card or for another tender or discount.

5.4. Gift Cards cannot be exchanged (wholly or partly) for cash.

5.5. Should we suspect any fraud relating to a Gift Card, we may refuse to redeem the Gift Card until we are satisfied that no fraud has occurred.

6. Your Gift Card, your responsibility:
You are responsible for the use and safety of your Gift Card. You are liable for all transactions on your Gift Card, except to the extent to which there has been fraud or negligence by us or by any of our employees.

7. Changes to Terms and Conditions:
7.1. To the extent permitted by law, we reserve the right to change any of the terms contained in these Terms and Conditions at any time, including without limitation changes:

7.1.1. to add or remove participating retailers and/or where the Gift Card may be redeemed;

7.1.2. to add or remove goods or services which may be purchased with the Gift Card;

7.1.3. for infrastructural, systems, administrative or operational reasons or to prevent the occurrence of fraud or other unlawful or unacceptable conduct;

7.1.4. to comply with any contract, law, regulation or statute or order or judgment of any court, tribunal or other body having competent jurisdiction; or

7.1.5. where we, acting reasonably, consider that it will not be to your detriment.

8. Force Majeure:
To the extent permitted by law, we will not be liable to you for any loss or damage (whether direct or consequential), nor be in default under these Terms and Conditions, for failure to observe or perform any of our obligations under these Terms and Conditions for any reason or cause which could not, with reasonable diligence, be controlled or prevented. These causes include acts of God, acts of nature, acts or omissions of government or their agencies, strikes or other industrial action, fire, flood, storm, riots, power shortages or failures, sudden and unexpected system failure or disruption by war or sabotage, and other acts or omissions of third parties.

9. Applicable Law
These Terms and Conditions are to be construed and enforced in accordance with the laws of New South Wales (NSW), Australia. Any dispute arising from your receipt or use of a Gift Card is exclusively subject to the jurisdiction of the courts of NSW, Australia (including the Federal Court of Australia, NSW Registry).
